Agreement to Terms
These Terms of Service ("Terms") govern your use of the website benchmarkhomeimprovements.com (the "Site") and any related services. Benchmark Home Improvements is a trade name of Veader and Co., a New Hampshire corporation ("Benchmark," "we," "us," or "our").
By accessing or using the Site, or by engaging our services, you agree to these Terms. If you do not agree, do not use the Site or our services.
About Our Services
We provide residential remodeling services, including kitchen and bath remodeling, additions, and related design-build services, primarily in New Hampshire and Southern Maine. Service availability, scheduling, pricing, and scope are subject to our discretion and capacity.
Eligibility
You must be at least 18 years of age and legally able to enter into contracts to request our services. If you are requesting services on behalf of a property you do not own, you represent and warrant that you have the authority of the property owner to do so.
Site Content and Intellectual Property
The Site and its content, including text, images, logos, photographs, project galleries, videos, and design elements, are the property of Benchmark Home Improvements or our licensors and are protected by intellectual property laws.
You may view and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any Site content without our prior written permission.
Estimates and Proposals
Estimates, proposals, preliminary drawings, and pricing information we provide are non-binding and do not constitute a contract for services. A binding agreement exists only when a written contract is signed by both parties.
We reserve the right to modify or withdraw any estimate or proposal prior to contract execution.
All remodeling work is performed under a separate written contract that governs scope, pricing, timeline, change orders, warranty, and dispute resolution. Nothing on this Site or in preliminary communications creates a contractual obligation to perform services.
Payment
For services under signed contract, we accept:
- Personal and business checks
- Credit card and ACH payments processed through TRUSS Payments
Payment terms, including deposit requirements, progress payments, and final payment, are specified in each signed project contract. Late payments may be subject to charges as set forth in the contract.
Warranty
Workmanship warranty terms for remodeling services are set forth in the signed project contract for each job. Any warranty we provide is limited to the terms of that contract.
Except as expressly stated in the signed contract, we make no other warranties, express or implied, regarding our services, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Manufacturer warranties on materials, fixtures, and appliances are passed through to the customer as provided by the manufacturer; we are not responsible for warranting materials we did not manufacture.
Third-Party Services and Links
The Site may include links to, or integrations with, third-party services (including TRUSS Payments, Google, and Meta Platforms). We are not responsible for the content, security, privacy practices, or availability of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
User Conduct
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to access non-public areas of the Site without authorization
- Collect or extract data from the Site through automated means
- Upload any code or content intended to damage, disable, or disrupt the Site
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with the proper functioning of the Site
Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.

Limitation of Liability
To the fullest extent permitted by law, Benchmark Home Improvements, Veader and Co., and our officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Site.
Our total aggregate liability for any claim arising from or related to your use of the Site shall not exceed one hundred dollars ($100.00).
This limitation does not apply to liability arising from willful misconduct, gross negligence, or any liability that cannot be limited under applicable law. Liability and obligations related to contracted remodeling services are governed exclusively by the signed project contract, not by these Terms.
Indemnification
You agree to defend, indemnify, and hold harmless Benchmark Home Improvements, Veader and Co., and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict-of-laws principles.
Dispute Resolution
Before initiating any formal legal action, the parties agree to attempt in good faith to resolve any dispute through informal negotiation for at least thirty (30) days after written notice of the dispute.
If the dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in Rockingham County, New Hampshire, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time at our discretion. Updates will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any signed project contract, constitute the entire agreement between you and Benchmark Home Improvements regarding the Site and our services, and supersede any prior agreements or understandings on these subjects.
